Service Agreement

NOTE: Rates may be subject to change without notice.

Standard fee is based on two (2) persons per site. Additional guests must be listed and fees may apply. Maximum occupancy cannot exceed local or state regulations.

Fees will be paid at the park’s website, HiddenOak.net, by credit card or by check, money order, or cashier’s check mailed to our PO BOX 543, Powderly, TX 75473 before the first day of the month.

A $150 Security Deposit and your first month site fee is expected at the time reservation is made which will be refunded upon departure from the park if no damage has been done AND guest gives at least 7-day notice prior to leaving. 

A late charge of $100.00 will be assessed if fees are not paid five days after due unless prior arrangements have been made in writing between the Guest and Host.

A $50.00 penalty fee will be charged for all returned checks.

In the event of a non-maintenance emergency please immediately call 911.

Under Texas law, you are not a tenant with a lease or contract. Guests who fail to comply with the rules, will be asked to leave without refund and may be prosecuted under “Theft of Services” and “Criminal Trespass” law. (TX Penal Code § 30.05(a) & 31.04(b)).

In this Service Agreement and Rules, Host refers to Hidden Oak RV Park and the Primary Guest is Guest.

If Host must give notice to terminate the Agreement for nonpayment of fees, Host shall not be deemed to have waived any right to terminate by accepting partial fees for the period involved. If Host gives notice to terminate this Agreement for any other reason, Host does not waive the right to terminate by accepting fees prorated to the termination date specified in the notice. In the event an apportionment of fees is necessary, fees shall be prorated on a day-to-day basis, with the monthly fee divided by the number of days in the month.

If any provision of this Agreement is held to be invalid, illegal or unenforceable then that provision shall not affect the validity, legality, or enforceability of the other provisions herein, then the parties agree that the remainder of this Agreement shall remain in forced and affect. Guest shall not seek recovery of damages from Host for attempting to enforce such provision, rule, regulation or policy in good faith prior to receiving notice of its invalidity or illegality.

Guest acknowledges and agrees that Host shall have no responsibility for Guest’s safety or the safety or protection of any of Guest’s possessions. Guest acknowledges that the park entrance is not guarded, the park has no security system or patrol and that Guest is responsible for securing their property in order to help prevent loss or damage. Guest agrees to notify Host or the police in the event lessee observes or learns of suspicious or illegal acts in the park. Guest acknowledges that all public areas of the park may be subject to video surveillance.

Guest’s successors and assigns, except for damages arising from intentional acts of Host, hereby irrevocably waives any right he/she/it had, has or may hereafter have to make any claim against Host (or its insurer) for damages to Guest’s personal property, including damages to Guest’s RV or trailer, which is the subject of the Agreement or while said personal property is located on Host’s property and guest agrees to save, protect, and hold harmless Hidden Oak RV Park.

The failure of Host, on one or more occasions, to enforce any term of this agreement shall not act as a waiver of the Host’s right to enforce that or any other term of this agreement at any time or any other occasion. 

Host’s decisions in all disputes are deemed final.

Host reserves all rights to terminate guests’ stay for any reason.

Rules

1. Guest agrees to obey all park rules contained in this list, posted on the park, and distributed in the future.

2. Guest shall not sublease or otherwise rent all or any portion of Guest’s RV or site. Any person that is not on file, may not stay more than five consecutive days.

3. No business or commercial activity of any nature shall be conducted in this park.

4. Guest is responsible for any additional guests in their site whether listed or visitors. Guest shall be responsible for all damage caused by themselves or any of their guests or visitors.

5. As needed, Guest is responsible for obtaining a post office box to receive their mail. Personal mail is not to be delivered to the RV Park address. Packages should not be delivered to the Park Address.

6. The maximum number of RV’s per site is one. Tents are not permitted.

7. The maximum number of vehicles per site is two. Cars, trucks, motorcycles, boats and trailers are all considered vehicles.  No parking permitted on roadways. No use of unauthorized vehicles will be allowed in the park.

8. All property including vehicles must be in the confines of the site.

9. No out-buildings, structures or fences of any kind may be erected anywhere within our facilities without the Host’s expressed written approval and consent. Exterior living spaces must be kept organized, clean, and visually appealing. No outside clothes lines are allowed. Any landscaping done to your site must not interfere with the lawn care provided by the Host. No appliances, mattresses, indoor furniture, large tools/machinery, trampolines, or any type of clutter is permitted without Host’s written approval and consent.

10. No RV’s or vehicles that fall into a state of disrepair will be allowed to remain in the park. (e.g., broken or cracked windows, flat tires, rusted, badly dented, or in need of paint)

11. No automobile or RV maintenance is allowed.

12. No washing of vehicles on park premises. Washing of RVs may be subject to an additional water use fee.

13. All RV’s must be leveled and supported with the proper equipment.

14. Keep sites clean and neat. Trash must be bagged and placed in dumpster.

15. Only toilet paper can be added to RV grey and black water discharges into the septic system. All other waste must go in the trash bag to the dumpster. Wastewater must be disposed of properly. No dumping on the ground. All sewer lines must be sealed on both ends with “donut” or threaded attachments from the RV and into the sewer. All sewer lines must be free from leaks. Sewer lines from the RV must be supported to enable proper flow and prevent puddling or backups.

16. Each RV will use one space and hookups for that assigned space only. Tampering in any manner with electric power sources or hookups, removing electrical breakers, modifying or altering electrical boxes, and/or running extension cords from a different power source other than the one assigned is prohibited. Using a greater electrical load than the RV is designed or approved for or otherwise causing a fire hazard is prohibited.

17. Guests shall not make any alteration to the electric, water, or sewer connections provided by the Host. Host’s responsibility shall extend only to the point of connections and the Host shall not have any responsibility for the condition or functioning of any pipes, conduits, or wires from such a point of connection to Guest’s RV. Host reserves the right to disconnect utilities to repair, make alterations, or additions to park. Host shall not be responsible for any loss suffered by any guest from planned or emergency shutdowns or power failures.

18. Guests wishing to utilize auxiliary propane tanks must obtain permission, in writing, to do so from the park manager. Unsafe and unsightly auxiliary propane tanks will not be permitted.

19. No mats or rugs on grassy areas.

20. No permanent attachments or cutting of trees is permitted.

21. No open fires except in barbeque grills or in small fire pits that are at least six inches above the ground. Homemade fire pits are not allowed.

22. Respect your neighbor and do not cut through their site.

23. No air rifles, BB guns, fireworks and/or sling shots are allowed in the park

24. No glass containers are allowed outside of RV’s and vehicles.

25. No illegal, onerous, noxious or offensive activity or behavior of any sort that could interrupt and/or adversely affect the enjoyment of other parties utilizing our facilities, including park staff, is allowed. Our quiet hours are from 10pm-7am and may be expanded depending on the working hours of the guests. Unreasonably loud and disturbing noise within the RV Park is always prohibited.

26. No generators may be used in the RV Park unless used in emergency situations of a power outage.

27. Pets are welcome as long as they are pet and people friendly. All pets must spend their primary existence within the RV. Pets must not be a nuisance to any other guest in the park or park staff. They are not permitted to be left outside unattended. Dogs must be on a leash at all times (unless in the dog park) and you must pick up after them. Host is not responsible for any pet left unattended in the RV at any time for any reason. Host reserves the right to withdraw pet privileges from any Guest.

28. Guest agrees that at the end of the term of their agreement Guest shall move the RV out of the park and shall have no right to leave it in the park. If someone buys the RV, the buyer must be preapproved to leave the RV, otherwise it must be moved immediately.

29. If Guest abandons the RV described herein, or any other personal property, Host may sell, store or destroy said RV or other personal property, as permitted under Texas law. Guest shall pay, upon demand, all costs and expenses incurred by Host in the moving, storing or destruction of Guest’s RV or personal possessions, plus court cost and attorney fees incurred in selling or otherwise disposing of the personal property and/or RV abandoned by the Guest. 30. Guest must maintain Liability & Property insurance with coverages at state minimums without any lapse in coverage. The insurance must cover the following: RV/Vehicle damage by tree breakage, flood, fire, theft, and/or other causes.
